Moving Away From The Other Parent
When the custodial parent seeks to move away from the area where the non-custodial parent lives, courts are required to balance numerous factors, which includes a consideration of the reasons for the move balanced against the non-custodial parent's fundamental human right to frequent visitation and, most significantly, by the best interests of the child. Other factors include: (i) the quality of the relationships between the child and the custodial and noncustodial parents; (ii) the impact of the move on the quantity and quality of the child's future contact with the noncustodial parent; (iii) the degree to which the custodial parent's and child's life may be enhanced economically, emotionally and educationally by the move; and (iv) feasibility of preserving the relationship between the non-custodial parent and the child through suitable visitation arrangements.
