Custody & Visitation

If one parent has sole residential custody of the child, the other parent has visitation.  Visitation need not be limited to alternating weekends.  Instead, visitation should be expansive, liberal and normalized to ensure that both parents have a hand in the child's upbringing.

Many sole custodial parents seek to restrict or minimize visitation with the child as a form of control over the other parent.  Telephone access, weeknight visits, holidays and regular contact is preferred, and aggressive representation will help achieve this result.

Enforcement of Visitation or Parenting Time

Violating a parenting time or visitation schedule is not looked favorably upon by courts.  If it is habitual, it may be a basis upon which to remove custody from the other parent as it can demonstrate unfitness.

If this is happening to you, contact us immediately to take the appropriate steps to protect your rights.

Modifying Support Awards and Custody Awards

Modifying support awards and custody awards can be a litigation minefield.  Once a support award, or a custody award, is finalized either by agreement or court order, it can be very difficult to change.  Usually, there needs to be changed circumstances sufficient to show the need to adjust a support award or to modify custody.

We specialize in such adjustments and modifications.  Contact us for a consultation.
